Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Bokrez platform, including the website bokrez.com, mobile applications and all its features (together the “Platform”), operated by 360 Tour — Obrt za virtualne zapise, Zagrebačka cesta 81, 10000 Zagreb, Croatia, OIB: 59456273095 (“Bokrez”, “we”). By registering or using the Platform, you agree to these Terms in full. If you do not agree, please do not use the Platform.

1. Service Description

Bokrez is a SaaS (Software as a Service) platform designed for service providers in the service industries and related sectors (“Business Users”), enabling them to:

  • Manage appointment bookings and calendar
  • Manage services, staff and working schedules
  • Communicate with clients and manage CRM data
  • Run loyalty programmes, gift cards and marketing campaigns
  • Access analytics and financial tracking
  • Maintain a business profile that allows end users (“Clients”) to book appointments

Bokrez is a tool that facilitates the relationship between Business Users and their Clients. Bokrez is not a party to the contractual relationship between Business Users and Clients and assumes no responsibility for the quality of services provided by Business Users.

Business Users are solely responsible for operating their business lawfully, including taxes, issuing invoices to their clients, fiscalization where applicable, permits, licences, consumer rights and all other regulatory obligations. Bokrez does not issue invoices on behalf of Business Users to their Clients unless such functionality is expressly enabled as a separate service.

2. Registration and User Account

To use the Platform, you must create an account. You agree to:

  • Provide accurate, complete and current information at registration and keep it updated
  • Keep your login credentials confidential and not share them with third parties
  • Notify us immediately of any unauthorised use of your account at [email protected]
  • Be responsible for all activities that occur through your account

Each individual or legal entity may maintain only one business account. Bokrez reserves the right to suspend or terminate duplicate or fraudulent accounts.

Bokrez may request reasonable documentation to verify identity, business activity, tax information, authorisation or lawful use of the Platform. If a Business User does not provide requested information, or if there are grounds to suspect fraud, tax abuse or unlawful activity, Bokrez may restrict, suspend or terminate access to the Platform.

Use of the Platform is permitted only to persons aged 16 or older. Persons under 16 may use the Platform only with parental or guardian consent. By registering, you confirm that you meet this requirement.

3. Subscription and Billing (Business Users)

3.1 Free trial

New Business Users receive a free trial period of 30 (thirty) days from the date of registration with access to all Platform features at no charge. After the trial period expires, access becomes restricted unless a paid subscription is activated.

3.2 Paid subscription

The standard subscription is €28.99 per month per business. A limited number of early users may keep the preferential rate of €19.99 per month while their account remains in good standing and active, unless otherwise agreed or required by changes in applicable law or tax treatment. Pricing for new users may increase to the standard price with at least 30 days’ prior notice.

Bokrez charges only the platform subscription. Bokrez does not process payments between Business Users and their clients — Business Users charge their own services directly to their clients.

The subscription can be paid by credit/debit card via Stripe (a licensed payment service provider) or by bank transfer. Card payments are processed by Stripe in accordance with their terms of service (stripe.com/legal). Bank transfers are made based on invoices issued by Bokrez to the Business User. Invoices are due within 15 days of the invoice date.

3.3 Late payment

In the event of non-payment by the due date, Bokrez reserves the right to:

  • Send a payment reminder
  • Restrict Platform access to read-only mode after a grace period of 15 days
  • Deactivate or suspend the account if non-payment continues for an additional 21 days after access restriction

3.4 Refunds

Subscription fees are non-refundable, unless Bokrez has prevented access to the Platform for reasons solely attributable to Bokrez for a period exceeding 72 consecutive hours. In such case, Bokrez will, upon request, proportionally compensate for the affected period.

Bokrez reserves the right to issue a refund outside of these conditions in individual cases, solely as a voluntary gesture, without creating any precedent or expectation for future refunds.

3.5 Referral programme

Business Users may generate a referral code. For each new Business User who registers using that code and activates a paid subscription, both the referrer and the referred user receive 1 (one) free month of subscription upon meeting the conditions. Bokrez reserves the right to amend or discontinue the referral programme with 14 days’ notice.

3b. Client Provisions

This section applies to end users (clients) who use the Platform to book appointments and access services from Business Users.

3b.1 Bookings and cancellations

Clients may book appointments through the Platform. Each booking is subject to confirmation by the Business User. Clients may cancel appointments through the Platform. Business Users may set their own cancellation policies which will be displayed at the time of booking. Bokrez is not responsible for the quality of services rendered.

3b.2 Service requests

Clients may post service requests on the Platform (reverse marketplace). Business Users may submit offers based on those requests. Clients are not obligated to accept any offer. Bokrez acts solely as an intermediary and does not guarantee the quality or accuracy of offers.

3b.3 Reviews and ratings

Clients may leave reviews and ratings for Business Users after a completed appointment. Reviews must be truthful, honest and based on actual experience. Bokrez reserves the right to remove reviews that violate these rules. Business Users may not condition the provision of service on a positive review.

3b.4 Messaging

The Platform enables direct communication between clients and Business Users. Users are responsible for the content of their messages. Bokrez does not monitor active conversations but may act upon abuse reports.

3b.5 Loyalty programmes and gift cards

Business Users may offer loyalty programmes (stamp cards, rewards) and gift cards through the Platform. The terms of such programmes are determined by Business Users. Bokrez acts as a technical intermediary.

3b.6 Mobile application

Bokrez provides mobile applications for iOS and Android devices. Use of the application is subject to these Terms. The application may request access to device location (to find nearby businesses), camera/photo library (to upload images), and push notifications (to receive reminders and messages). All permissions are voluntary and may be revoked in device settings. Clients may sign in using Google Sign-In or Apple Sign-In, thereby accepting the terms of those services.

4. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. The following is expressly prohibited:

  • Using the Platform for illegal activities or in violation of applicable law
  • Using the Platform for tax fraud, tax evasion, concealment of revenue or facilitating non-issuance of required invoices to Clients
  • Misrepresenting yourself or providing false information about services rendered
  • Sending spam, unsolicited messages or marketing content without recipients’ consent
  • Attempting to gain unauthorised access to systems, accounts or third-party data
  • Automatically scraping Platform content without written permission
  • Using the Platform in a manner that could damage, overload or disrupt its operation
  • Distributing malicious software, viruses or any other harmful code
  • Publishing false, offensive, discriminatory or unlawful reviews or comments

Bokrez reserves the right to remove content or suspend accounts that violate these rules, without prior notice and without right to compensation.

5. Intellectual Property

All intellectual property rights in the Platform, including source code, design, logos, trademarks, databases and documentation, are owned by 360 Tour — Obrt za virtualne zapise or its licensors. These Terms do not transfer any intellectual property rights to you.

We grant you a limited, non-exclusive, non-transferable and revocable licence to access and use the Platform solely for the purposes envisaged by these Terms.

Content you upload to the Platform (business photos, service descriptions, etc.) remains your property. You grant Bokrez a non-exclusive, royalty-free licence to display that content within the Platform for the purpose of providing the service.

6. Service Availability

Bokrez aims to ensure Platform availability of 99.5% on a monthly basis, excluding scheduled maintenance. Bokrez does not guarantee uninterrupted or error-free availability and is not liable for temporary technical disruptions.

In the event of scheduled maintenance causing unavailability of more than 2 hours, Bokrez will notify Business Users at least 24 hours in advance, except in urgent security situations.

7. Disclaimer and Limitation of Liability

The Platform is provided “as is” and “as available” without any express or implied warranties, including but not limited to warranties of fitness for a particular purpose or suitability for specific business needs.

Bokrez is not liable for:

  • Content published by Business Users or Clients on the Platform
  • The quality or legality of services provided by Business Users to Clients
  • Disputes between Business Users and Clients
  • Data loss arising from circumstances beyond our reasonable control
  • Indirect, incidental or consequential damages arising from use of or inability to use the Platform

Bokrez’s total liability to you is limited to the amount you have paid for the subscription in the 3 (three) months preceding the damage event, or €100, whichever is greater. These limitations do not apply in cases of Bokrez’s wilful misconduct or gross negligence.

The Business User agrees to indemnify and hold Bokrez harmless from all claims, penalties, costs, damages and expenses arising from the Business User’s services or business activity, unlawful use of the Platform, breach of tax, fiscalization, consumer, licensing or regulatory obligations, or disputes between the Business User and its Clients.

8. Data Protection

The processing of your personal data is governed by our Privacy Policy.

Business Users who use Bokrez to process personal data of their Clients as Data Controllers must enter into a Data Processing Agreement with Bokrez. The standard Data Processing Agreement is available at bokrez.com/en/dpa. By registering and using the Platform you accept the terms of that Agreement, which forms an integral part of these Terms.

9. Termination

9.1 Termination by Business User

You may cancel your subscription at any time through the account settings or by sending a request to [email protected]. Access remains active until the end of the paid billing period. The fee paid for the current period is non-refundable.

9.2 Termination by Bokrez

Bokrez may terminate or suspend your access with immediate effect if:

  • You breach these Terms or applicable law
  • You have not settled outstanding obligations within the period set out in section 3.3
  • There is reasonable suspicion of fraud, tax abuse, false information, unauthorised business activity or other unlawful activity
  • Your use of the Platform threatens the security, availability or integrity of the Platform or third-party data

In the event of termination without justifiable cause by Bokrez, we will proportionally refund the unused portion of the paid subscription.

9.3 Data after termination

After account termination, your data will be retained for 30 days during which you may export it. After that period, data is permanently deleted, except where a statutory retention obligation applies.

10. Changes to Terms

Bokrez reserves the right to modify these Terms. We will notify you of material changes by email and/or a prominent notice on the Platform at least 30 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you have the right to cancel your subscription without penalty before the effective date.

11. Governing Law and Dispute Resolution

These Terms are governed by the law of the Republic of Croatia. For any disputes arising from or in connection with these Terms, the parties will endeavour to reach an amicable resolution. If this is not possible within 30 days of a written request, the Commercial Court in Zagreb shall have jurisdiction.

Consumers residing in the EU may also use the European Commission’s online dispute resolution (ODR) platform at ec.europa.eu/consumers/odr.

12. General Provisions

These Terms constitute the entire agreement between you and Bokrez regarding use of the Platform and supersede all prior agreements. If any provision of these Terms is found to be invalid or unenforceable, the remainder of the Terms remains in force. Bokrez’s failure to enforce any right does not constitute a waiver of that right.
